Individuals
who pass bad checks are liable for criminal prosecution,
although emphasis
is placed on monetary restitution to those who
are victimized.

The following
steps should be taken by individuals and businesses
wishing to resolve
a bad check they have received.
1. Submit the bad check
to the bank twice. If the bank does not honor
the check the second time,
send the passer a letter stating the check has been returned
by the bank. In the letter, give the passer 10 days to honor
the check. Mail this letter certified mail, return receipt requested.
After the 10 day period has elapsed, if the check has still not
been paid, call the Mason Police Department at 925-2525.~2. A Mason Police Officer
will be dispatched to your home or place of
of business. the officer
will take a report from you on the bad check. You will need to
give the original check to the officer along with a copy of the
certified letter, and return receipt, thatyou sent to the passer.

3. The Mason Police Officer
will conduct a criminal investigation, utilizing
the information you provided
when you filed the police report.~4. If the investigation
reveals that the offense is a misdemeanor, the officer
will notify you. It will
then be your responsibility to file criminalcharges in Mason Municipal
Court.~5. If the investigation
reveals tht the offense is a felony, the officer will
notify you. Then he will
file the charges in court, on your behalf.You may be needed to testify
in court, regardless of whether the offense is a misdemeanor
or felony.~6. The Court may order
restitution of the check if the offender is found
guilty.~7. If you have any questions
