I, Jesse Oxley, of Wayne Coounty, in the state of Indiana do make and publish this my last will and testament hereby awaking and making void all former wills by me at anytime heretofore made.

First, I direct that my body be decently interred and that my funeral be conducted in a manner corresponding with my state and situation in life and as to such worldly estate as it has pleased God to intrust me with, I dispose of same in the following manner, to wit:

I direct first that all my just debts and funeral expenses be paid as soon after decease as possible (page 2) out of the money that shall come to the hands of my executor, executrix from any portion of my personal property; also direct that a fair valuation or appraisement be made by three judicious neighbors of all my said estate including my household furniture; I also direct that a sale or auction be made on such items as my executor, executrix may think proper. I give and bequeath unto my beloved wife, Mary Oxley, one-third of all my personal property, the other two-thirds I desire to be sold at said auction, all allowing my wife to first select her third and if there should remain any overplus after defraying my debts, I desire that it should be paid over to my wife, Mary, to be used and disposed of as she may see proper. It is also my wish and desire that my wife, Mary, shall have the exclusive use and benefit of the farm and tract of land on which we now live during her natural lifetime. At her death, I desire that the farm shall be sold and that an equal dividend be made amongst my several children and I hereby make and ordain my worthy friend, James Strode, and my beloved wife, Mary Oxley, my executor and executrix of this my last will and testament - in witness which I, Jesse Oxley, the testator, have hereunto set my hand and seal this 12th day of November in the year of our Lord eighteen hundred and forty-six.

Signed, sealed and published and delivered by the above named Jesse Oxley in this his last will and testament in the (page 3) presence of us who have hereunto subscribed our names as witnesses hereto in the presence of the said testator and in the presence of each other.

Personally appeared in open court on the 9th day of February 1847 at the February term David Cornelius and Martin Keever, the subscribing witnesses to the foregoing last will and testament of Jesse Oxley who being duly sworn on oath say they were present at the execution of the said last will, that the same was duly executed, that said testator was of sound mind and memory and not under any coercion or restraint and that he requested them to subscribe said last will as witnesses, then to which they accordingly did in the presence of said testator and in the presence of each other.
